Holiday Rental Terms & Conditions

1. Introduction

These Terms & Conditions (“Agreement”) apply to all short-term holiday accommodation bookings made with Kriani Collection (“we”, “us”, “our”) and are binding upon the guest(s) (“you”, “your”). By proceeding with a booking, you confirm that you have read, understood, and agree to abide by the terms set out below.

2. Booking and Payment

  • Booking Confirmation: A booking is secured upon receipt of a non-refundable deposit equal to 30% of the total accommodation cost.

  • Payment Schedule: The remaining balance is due 30 days prior to check-in and will be automatically charged to the payment method provided at the time of booking.

  • Failure to Pay: If the final payment cannot be processed on the due date, the booking will be automatically cancelled without refund of the deposit.

  • Payment Methods: Payments are accepted via Visa or Mastercard. A 1.5% card processing fee applies.

  • Security Bond: For bookings exceeding 7 consecutive nights, a security bond may be required. The bond amount and terms will be confirmed at the time of booking. For stays of 7 nights or less, no bond is required unless otherwise advised in writing.

  • Minimum Age: The person booking and staying at the property must be at least 18 years of age at the time of booking.

3. Cancellation and Refund Policy

  • Guest-Initiated Cancellations:

    • Cancellations made more than 30 days prior to arrival will incur a cancellation fee equal to 30% of the total booking amount (i.e. the deposit).

    • Cancellations made within 30 days of arrival are non-refundable.

  • Provider-Initiated Cancellations: In the rare case that we must cancel a confirmed booking, a full refund will be provided, and we will assist in sourcing comparable alternative accommodation.

4. Check-In and Check-Out

  • Check-In Time: From 3:00 PM on the day of arrival.

  • Check-Out Time: By 11:00 AM on the day of departure.

Late check-outs must be requested and confirmed in writing prior to departure. Unauthorised late departures will incur:

  • AUD $200 for the first hour, and

  • An additional AUD $100 for every hour thereafter.

These fees reflect the impact of delays on same-day cleaning and incoming guests.

5. Occupancy and Use

  • Maximum Occupancy: Strictly limited to 4 guests.

  • Over-Occupancy: The number of guests must not exceed the number stated in the booking confirmation. If more guests are found to be staying at the property than permitted, it will constitute a serious breach of these terms and the stay will be terminated immediately without refund.

  • Use of Premises: The property is to be used strictly for short-term holiday accommodation. Parties, events, and commercial use are not permitted.

  • Noise and Disturbance: Guests must not create excessive noise or disturbances that may impact neighbouring properties. Quiet hours are enforced from 9:00 PM to 8:00 AM.

6. Guest Responsibilities

  • Identification: Valid government-issued photo ID for all adult guests must be provided prior to check-in. Check-in instructions will not be issued until ID is received.

  • Property Care: Guests must maintain the property in good condition. Any damage, breakage, or maintenance issues must be reported immediately. Guests are financially responsible for any damage caused during their stay.

  • Housekeeping: The property is professionally cleaned before each stay. Mid-stay cleaning can be arranged for extended bookings at an additional cost. Excessive mess or damage will result in additional cleaning or repair fees.

7. Smoking and Pets

  • Smoking: Smoking is strictly prohibited anywhere on the premises, including inside the property and on all balconies and outdoor areas. Breaches will incur additional cleaning and deodorising charges.

  • Pets: Pets are not permitted. If an unauthorised pet is brought onto the premises, a professional allergen and bio-remediation cleaning fee of AUD $400 will be charged to restore the property to a hypoallergenic standard.

  • Assistance Animals: If you require a certified assistance animal, appropriate documentation must be provided at the time of booking. Failure to do so will be considered a breach of terms and may result in immediate termination of the stay without refund.

8. Amenities and Services

  • Wi-Fi: Complimentary Wi-Fi is provided as a convenience for guests. As this service is delivered by a third-party provider, no guarantee is made regarding availability or speed, and no refunds or compensation will be provided for any outages or connectivity issues.

  • Appliances and Facilities: Guests must use appliances and amenities responsibly and follow any provided instructions. Malfunctions must be reported as soon as possible. While we will take reasonable steps to resolve issues, compensation is not available for matters beyond our control.

9. Queensland Environment – Insects and Wildlife

Due to Queensland’s tropical climate, occasional sightings of geckos, flies, spiders, ants, cockroaches and similar small insects may occur. These are part of the natural environment and do not indicate a lack of cleanliness or maintenance. The property is professionally cleaned and treated, and sightings will not be considered grounds for refunds or cancellations.

10. Liability and Insurance

We do not accept responsibility for accidents, injuries, loss, or damage to guest property during the stay. Guests are encouraged to obtain appropriate travel insurance.

11. Force Majeure / Unforeseen Circumstances

We are not liable for failure or delay in performance due to events beyond our control, including but not limited to natural disasters, power outages, internet disruptions, pandemics, government restrictions, or other emergencies.
In such cases, we will work with you to reschedule your stay where possible, however, refunds will only be issued in accordance with our standard cancellation policy.

12. Right of Entry

We reserve the right to enter the property for essential maintenance, inspections, or emergencies. Notice will be provided where reasonably practical.

13. Guest Conduct and Termination of Stay

We reserve the right to terminate any stay without refund if guests engage in unlawful activity, cause damage, bring unauthorised pets, exceed the permitted number of guests, or breach any part of these Terms & Conditions.

14. Lost Property

If personal belongings are found after check-out, we will make reasonable efforts to contact the guest. Items will be held for up to 7 days from the date of check-out. If unclaimed after this time, items will be considered abandoned and disposed of appropriately. Postage and handling fees apply for returning lost items.

15. Governing Law

This Agreement is governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
